Calendaring Mediations
Almost all mediations today are done via Zoom, as it is easier and less expensive for everyone (travel is no longer necessary). I confirm all mediations by e-mail to make absolutely certain of the date, time, and location. If needed, however, I HAVE AVAILABLE BEAUTIFUL MEDIATION FACILITIES LOCATED ON LAKE EOLA SHORELINE IN DOWNTOWN ORLANDO, WITH SNACKS AND DRINKS PROVIDED.
It is my policy and practice to schedule mediations for one half day or a full day (or longer if necessary). Half day mediations generally start at 9:00 A.M. or 1:30 P.M; however, I will accommodate your schedule as necessary. When scheduling a mediation, please keep in mind that if you reserve a morning for one half day and another mediation is scheduled for that afternoon, the morning mediation will have to conclude in time for the afternoon mediation to begin when scheduled. This may necessitate a continuation or adjournment of the mediation depending on how the parties and counsel wish to handle the situation.
Mediation Fees
1. Personal Injury/Commercial cases: circuit court: $550 per hour; county court: $350
2. Medical Malpractice cases: $650 per hour;
3. Family Law cases: $375 per hour;
4. Mandatory HOA v. Homeowner cases (pre-suit cases only): $260 per hour.
5. Workers Compensation cases: $300 per hour.
As is routinely provided for in court-ordered mediation, mediation fees are due and payable at the conclusion of the mediation. As a courtesy to counsel, I will invoice counsel following the mediation with the expectation that the fee will be paid within twenty (20) days of the mediation. If a party is not represented by counsel, that party will be expected to pay at least a portion of their share of my fees 5 days in advance of the scheduled mediation and to bring with them a check/cash to pay at the conclusion of the mediation any remaining fee due, if any. In the case of governmental entities, counsel will receive an invoice following the mediation. Please remember that I have no ongoing relationship with mediation parties, therefore, it is my expectation that, other than with governmental entities, counsel will ultimately be responsible for payment of the mediation fee.
The mediation fee is usually divided evenly between the parties unless otherwise agreed to by the parties or ordered by the Court. If you have any questions about who is considered a party, please contact me for clarification before the case.
My charges are in 1/4 hour increments and I have a two (2) hour minimum charge for half day and a four (4) hour minimum charge for full day mediations. Anything over the minimum will be billed in 1/4 hour increments and will be payable at the end of mediation unless prior arrangements have been made.
Travel Time
I do not charge for travel time in the State of Florida.
Preparation Time
I do charge for preparation time, but only if preparation time is expended. Preparation time is typically charged for review of court files and/or pre-mediation submissions and documents, pre-mediation conferences or teleconferences with counsel or unrepresented parties, and preparation of draft mediation agreements. Typically, preparation for half-day cases ranges from ½ hour to one hour, and one to two hours for full-day cases.
Cancellation Fees:
I do not charge for cancellations unless it is within 48 hours of the scheduled mediation. If within 48 hours, I charge 2 hours for half-day mediations and 4 hours for full-day mediations.
Pre-Mediation Submissions
Pre-mediation submissions including factual information about the case, legal issues, previous negotiations if any, the nature of the parties and their relationship with each other, and any information you feel would help me better understand the case to be mediated and the personalities involved, are very helpful.
In the event there is insufficient time to prepare and send a pre-mediation submission, feel free to call me before the mediation with any last minute information. Any such conversations will be kept in strict confidence unless you instruct me otherwise.
Also, please let me know at the earliest possible time of any security or health-related concerns so that appropriate arrangements can be made.
